New housing law in Spain

The Government approves the most ambitious housing law in democracy

The Council of Ministers has given the green light to the housing law, which seeks to guarantee the right to decent and affordable housing for all citizens. The norm, which has been agreed upon with the social agents and the autonomous communities, introduces historic measures such as the limitation of rental prices in areas declared stressed, the extension of the minimum duration of rental contracts, the prohibition of evictions without a housing alternative, the creation of a public social housing stock and the promotion of the rehabilitation and energy efficiency of homes.

The third vice president and Minister of Social Rights and Agenda 2030, Ione Belarra, has described the housing law as "the most ambitious in democracy" and has highlighted that "it responds to a very broad and very urgent social demand." According to Belarra, the housing law "puts an end to a situation of lack of protection and precariousness that affects millions of people, especially young people and the most vulnerable families." Likewise, she has assured that the housing law "contributes to the economic and social recovery of the country, by generating employment, energizing the construction and rehabilitation sector and reducing energy poverty and greenhouse gas emissions."

The housing law will come into force the day after its publication in the Official State Gazette, except for some articles that will have a longer adaptation period. The rule provides for a transitional period of six months for the autonomous communities to prepare and publish the reference indices of rental prices, which will serve as a basis for limiting them in stressed areas. In addition, the housing law establishes a system of incentives and sanctions to encourage compliance with its provisions and prevent speculation and fraud.

The housing law has been received with satisfaction by social groups and tenant organizations, who consider it a historic advance to guarantee the right to housing. However, the rule has also generated criticism and rejection from some sectors, such as owners, developers, investors and experts, who see it as an excessive and counterproductive intervention in the rental market, which can have adverse effects. such as the reduction in supply, the increase in the underground economy, the discouragement of investment and the improvement of housing and the violation of private property and legal security.
